Abandoned Boat Legislation Passes in House, Senate Vote Next

On Wednesday, June 1st, House Bill 5429 was passed through the House of Representatives at a vote of 108-1. Representative Andrea LaFontaine,
MBIA Executive Director Nicki Polan, MBIA legal counsel Jim Stewart, and MBIA lobbyist Brett Marr have headed the efforts with HB 5429 in order to aid MBIA members and marine businesses around the state dealing with abandoned vessels at their facilities. The current problem lies in that the Secretary of State's office is only required to keep accessible title records for 7 years, and as of now, procedures do not provide a process to foreclose on vessels titled in another state. So without a Michigan title, marinas around the state cannot file a lien to recoup storage and repair costs they have incurred, nor can they sell or destroy these boats to remove them from their property. The Bill moves to the Senate where it is expected to pass shortly after summer break. We will keep you posted.
